Terms of Service

1. Acceptance of Terms

By accessing or using the PlayServe platform ("Platform"), operated by PlayServe Co. ("PlayServe," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Description of Service

PlayServe is an all-in-one court booking and venue management platform for sports facilities. Our services include:

• Online court and facility booking
• Open play and queue management
• Payment processing and invoicing
• Point-of-sale (POS) system for venues
• Online shop and inventory management
• Coaching session scheduling
• Vouchers and loyalty programs
• Venue analytics and reporting

3. User Accounts

To use certain features, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity under your account.

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have parental or guardian consent.

4. Booking and Cancellation

When you book a court or facility through PlayServe, you enter into a reservation agreement with the venue operator. PlayServe acts as an intermediary to facilitate the booking.

• Cancellation policies are set by individual venue operators and will be displayed at the time of booking
• Refund eligibility depends on the venue's cancellation policy and timing of cancellation
• PlayServe is not responsible for venue closures, maintenance, or other disruptions managed by the venue operator
• No-shows may result in forfeiture of the booking fee per the venue's policy

5. Payment Terms

PlayServe supports multiple payment methods, including GCash, PayMaya, credit cards, and cash payments at the venue. All online payments are processed through third-party payment processors (such as Xendit).

• Prices are displayed in Philippine Pesos (PHP) unless otherwise stated
• You agree to pay all fees and charges associated with your bookings and purchases
• PlayServe may charge platform or service fees, which will be disclosed before payment
• Venue operators set their own pricing for court rentals, equipment, and services

6. Venue Operator Responsibilities

If you are a venue operator using PlayServe, you agree to:

• Provide accurate information about your facilities and availability
• Honor confirmed bookings made through the Platform
• Maintain safe and playable facilities
• Set clear and fair cancellation and refund policies
• Comply with all applicable local laws and regulations
• Handle player data received through PlayServe in accordance with the Philippines Data Privacy Act of 2012

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Create false or misleading accounts or bookings
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to other users' accounts
• Scrape, harvest, or collect data from the Platform without permission
• Use the Platform to send spam or unsolicited communications

8. Intellectual Property

All content, trademarks, logos, and software on the PlayServe platform are the property of PlayServe Co. or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

Venue operators retain ownership of their own content (photos, descriptions, pricing) uploaded to the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, PlayServe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to:

• Injuries or accidents occurring at venue facilities
• Disputes between players and venue operators
• Payment processing errors by third-party providers
• Loss of data or business interruption

PlayServe's total liability for any claim arising from these Terms shall not exceed the amount you paid to PlayServe in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the Platform or other users.

You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these Terms will survive (including limitations of liability and governing law).

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these Terms shall be resolved in the courts of Dumaguete City, Negros Oriental, Philippines.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of PlayServe after any changes constitutes acceptance of the revised Terms.
